1. General Terms

Vintage Wine and Travel is a U.S. based LLC providing curated and guided tour packages for guests. As a tour provider, we do not own the transportation companies, hotel and lodging facilities, restaurants or other food service providers, wineries, or local sightseeing venues, or other service providers. These services are secured and purchased on behalf of participants. The following terms and conditions apply to tours provided by Vintage Wine and Travel (“the Company”) and participants booking the tour (“the Participant).

2. Booking and Payment

– Payments: Please note that Vintage Wine and Travel only accepts credit card payments from Visa, Mastercard, and American Express. All other payment methods are not accepted.

– Deposit: A non-refundable deposit of $250 per person is required at the time of booking to secure your place on the Tour.

– Final Payment: The balance of the Tour price is due no later than 90 days prior to the scheduled departure date. If full payment is not received by this date, the Company reserves the right to cancel the booking and retain the deposit.

– Late Bookings: Bookings made within 90 days of the departure date must be paid in full at the time of booking.

3. Cancellations and Refunds

– Cancellation by Participant: If the Participant wishes to cancel their booking, the following cancellation fees apply:

  – More than 90 days before departure: Full refund of the balance, minus the deposit.

  – 90 to 60 days before departure: 50% of the total Tour price.

  – Less than 60 days before departure: No refund.

– Cancellation by the Company: In the rare event that the Company needs to cancel or alter the Tour, the Participant will be notified, and a full refund of any payments made will be provided. The Company is not responsible for any other costs incurred by the Participant due to such cancellations.

4. Travel Insurance

The Company strongly recommends that all Participants purchase travel insurance to protect themselves against unforeseen events such as illness, injury, or cancellation. Travel insurance may be purchased separately or through the Company, but is not included in the cost of the Tour.

5. Air Travel and Tour Origin

  • Air transportation is not provided by or included in tours. Airfare must be secured by Participants independently. Tours originate at a designated site, such as Paris-Charles de Gaulle Airport or Bordeaux-Merignac Airport and Participants are responsible for arranging their own air transportation to the designated tour origin location
  • Delayed Arrival: If you experience a delay in your arrival, whether due to flight issues or other unforeseen circumstances, please inform us as soon as possible. While we will make every reasonable effort to accommodate you, please be aware of the following terms:

**Late Arrival to the Tour Start Point: If you miss the scheduled start time or any portion of the tour, we cannot guarantee a re-schedule or refund for missed activities, as our tours are often time-sensitive and may involve pre-arranged bookings with hotels, restaurants, and local vendors.

** Participant Responsibilities: You are responsible for ensuring that your travel arrangements allow for timely arrival at the tour origin. If you miss the tour’s starting point due to late arrival, it is your responsibility to catch up with the group at the next available location or activity, if applicable, at your own cost. The Company will support participants with connecting up with the tour. 

**Accommodation or Transportation Delays: If your delay requires additional accommodations or transportation beyond the planned itinerary, you are responsible for any extra costs incurred as a result.

– Please note that no refunds will be issued for missed portions of the tour due to late arrivals or travel delays. We recommend purchasing travel insurance that covers delays and other travel disruptions to safeguard your plans.

– If you have any concerns about your travel timing or need assistance, please don’t hesitate to reach out to us prior to your tour. We’re here to help ensure that your experience is as smooth and enjoyable as possible.

6. Health and Safety

– Assumption of Risk: The Participant understands that traveling and participating in tours and the consumption of alcohol can involve risks, including but not limited to injury, illness, or loss. The Participant agrees to assume all risks associated with the Tour.

– Liability Disclaimer: The Company, its owners, guides, agents, and suppliers are not liable for any injury, loss, damage, delay, or other claim arising out of the Participant’s participation in the Tour, except where caused by the Company’s negligence or intentional misconduct. The Participant is responsible for ensuring that they are fit to travel and participate in the Tour.

– Medical Requirements: The Participant agrees to inform the Company of any pre-existing medical conditions or other relevant health issues that could affect their participation in the Tour. The Company reserves the right to request medical clearance for certain activities, and may refuse participation based on health concerns.

7. Age Restrictions and Alcohol Consumption

  • Legal Drinking Age: In accordance with U.S. law, the legal drinking age is 21 years old. All Participants must be at least 21 years of age to partake in wine tastings and any other activities involving alcohol during the tour.
  • Verification of Age: The Company reserves the right to request valid government-issued photo identification (e.g., passport, driver’s license) from any Participant to verify their age before allowing participation in wine tastings or alcohol-related activities. Failure to provide proper identification may result in denial of access to these activities without a refund.
  • Minors: Participants under the age of 21 are not permitted to attend wine tastings or participate in alcohol-related activities. If a minor is accompanying an adult Participant, they may still join the tour, but they must remain under the supervision of an adult at all times. However, participation in wine-related events, such as tastings, is strictly prohibited.
  • Alternative Activities for Minors: If a minor is accompanying a Participant, the Company will ensure that alternative, non-alcoholic activities are made available to them. These may include scenic tours, visits to vineyards and wineries (without tasting), and local cultural experiences.

8. Participant Behavior and Responsibility

  • Code of Conduct: Participants must behave in a respectful manner towards fellow travelers, local residents, and tour guides. The Company reserves the right to remove any Participant from the Tour for behavior deemed disruptive, illegal, or inappropriate, without refund.
  • Alcohol Consumption: The wine tours involve tastings of alcoholic beverages. The Company encourages participants to drink responsibly and adhere to all local laws regarding alcohol consumption.
  • Responsibility for Belongings: The Company is not responsible for lost, stolen, or damaged property during the Tour. Participants are advised to keep personal belongings secure and carry travel insurance to cover any losses.

9. Changes to the Itinerary

– The Company reserves the right to modify or amend the Tour itinerary, accommodation, or services at any time and for any reason, including changes due to venue availability, weather conditions, or unforeseen circumstances.

– If significant changes are made to the itinerary, the Participant will be notified as soon as possible and may be offered alternative options, depending on the nature of the change.

10. Force Majeure

The Company will not be liable for any failure to perform its obligations if such failure is caused by events beyond its reasonable control, including but not limited to acts of God, war, civil unrest, strikes, natural disasters, or government regulations.

11. Travel Documents

The Participant is responsible for ensuring they have valid travel documents (passport, visa, etc.) and any required legal documents for the Tour. The Company is not liable for any issues arising from invalid or incomplete documentation.

12. Governing Law and Dispute Resolution

– This Agreement is governed by the laws of The United States of America.

– Any dispute arising under or in connection with this Agreement will be resolved through mediation or, if necessary, through arbitration, as per the rules of the American Arbitration Association (AAA) in San Francisco, California.

13. Privacy and Data Protection

  • The Company respects the privacy of Participants and will handle personal information in accordance with applicable data protection laws. Personal information will only be used for the purpose of administering the Tour and will not be shared with third parties without consent, unless required by law.

Third-Party Service Providers: The Company may share necessary information with third-party service providers (e.g., accommodation providers, transport companies, etc.) solely for the purpose of fulfilling your booking.

14. Acknowledgment and Acceptance

By making a booking with Vintage Wine and Travel, you acknowledge that you have read, understood, and agree to these Terms and Conditions. These Terms and Conditions may be updated from time to time, and the most recent version will be available on our website.
